I'VE.1 t1ST READ the article on the smoking ban and the problems it could cause for operators (CM 22 December 2005).

It would be up to the HSE to enforce these rules hut have you ever contacted the HSE regarding the issue!! have, and was told it didn't recognise the cab of a truck as a workplace and therefore wouldn't, or couldn't, enforce the rule.

In order to enforce the smoking ban, the HSE would have to recognise the cab of a truck as a workplace. On the plus side, this would mean that more drivers were protected by the USE while in their workplace. which at the minute they are not.
