A DERBYSHIRE haulier who has been using an unauthorised operating centre in the West Midlands has been given 28 days to comply with regulations.

The licence for two vehicles and two trailers held by Fostonbased Andrew Jennings, trading as AR Jennings UK European Transport. has been revoked by North Western Traffic Commissioner Beverley Bell.

However, the TC delayed her decision by 28 days. She said she would be prepared to grant interim authority provided that maintenance was carried out by an outside contractor. Jennings would have six months to comply.

Vehicle examiner David Howard said that a maintenance investigation in May 2008 revealed that an undertaking given at a public inquiry (PI) in 2002, that roller brake tests be carried out twice a year, had not been done, and that an annual test pass rate of 40% was poor. In the past five years, there had been two immediate prohibitions issued.

Admitting he had been parking at his maintenance contractor's premises instead of the operating centre. Jennings said he was carrying high-value loads of agricultural machinery and large trees and that there was a gypsy encampment close to his operating centre. He was applying for a new licence to regularise the position.

Jennings said he had ceased having roller brake tests when the nearby BRS depot closed down. He had started having roller brake tests in January He had achieved a 100% annual test pass rate in 2008, which he intended to reach again.

The TC pointed out that the inspection records since July 2008 showed no defects on a nine-yearold vehicle, which made her suspect they were just a paper exercise. Denying this, Jennings said that because he drove the vehicle himself he saw to defects on a daily basis.
