A NORTH WESTERN company has lost its appeal against the refusal of Traffic Commissioner Beverley Bell to grant its licence application because it had failed to provide requested financial information.

On 7 July last year AJ Transport had applied for a licence for eight vehicles and eight trailers.

In July and August the Traffic Area Office wrote asking for supporting documentation, pointing out that £21,100 was required in capital and reserves, in September the firm sent in a statutory declaration from a Paula Taylor undertaking to make £10,000 available to it.

The TC had noted that the application was only supported by that declaration, an overdraft facility of £14,000 and a balance of £997.93 on a bank statement dated 18 June. The three months' bank statements she had requested had not been received. She had Lilso noted that the firm's two principals were connected with two other licences. One of these had been revoked for failing to comply with undertakings and financial problems: the other had not been granted because of the lack of satisfactory finances.

The firm claimed the IC's decision was wrong because it could provide for its routine hills from receipts. Dismissing the appeal, the Transport Tribunal said that as previous licence holders the firm's failure to supply supporting documentation was at best casual and was at worst disrespectful of the licensing system and the TCs' obligations under it.
