Which of the following most accurately describes the problem?

A MERSEYSIDE COMPANY has been given three months to save its 0-licence for six vehicles and six trailers. Birkenhead-based Chris Reynolds Pallets (NW) had been called before North Western Traffic Commissioner Beverley Bell at a St Helens disciplinary inquiry.

Vehicle examiner Roger Byrom told the TC that the firm's fleet had attracted three immediate and nine delayed prohibitions over the last five years.

During a fleet inspection in August he had imposed an immediate prohibition for a fuel leak and a delayed prohibition fora tyre defect. Many inspection records were missing or incomplete and inspection intervals were being exceeded.

Though the driver defect reporting system he had suggested had since been put in place it needed to be properly enforced — inspection records produced at the hearing showed a number of driver related defects. The initial failure rate at annual test was 100%.

Transport manager James Reynolds said the maintenance records had got into a mess after they changed maintenance contractors. The new company had gone into liquidation and they had now returned to their original contractor.

Reynolds agreed that inspection periods were still not being adhered to, with one vehicle going for four months without an inspection, blaming the problem on poor organisation. He asked for time to show they could do things properly.

Cutting the licence to five vehicles and five trailers, and adjourning the hearing until May,theIC ordered all the vehicles to have fresh annual tests within 14days.

She described Reynolds' conduct as cavalier in the extreme and concluded the company had been negligent to the point of recklessness.
