Which of the following most accurately describes the problem?

• Maintenance problems have stalled a hid by haulier Richard Francis of Hartlebury, Worcester to more than triple his licence authorisation.

Francis had applied to add five vehicles and five trailers to his existing licence for two vehicles and two trailers. At a Birming ham public inquiry West Midland Traffic Commissioner John Mervyn Pugh pointed out that a number of prohibition notices had been issued to Francis' vehicles and trailers.

Francis said that a prohibition in February 1997 had been

imposed on a trailer which did not belong to him, but the IC said that did not matter as Francis was responsible for the condition of any trailers his vehicles were hauling. The trailer concerned had eight defects.

Mervyn Pugh added that another prohibition had been imposed in August for a worn tyre, and in October a vehicle and trailer both received prohibitions. Francis said that in this case the trailer belonged to Cardiff Transport. The driver should have checked it over, but failed to do so.

Adjourning the application. Mervyn Pugh said that Francis had to prove he could run two vehicles and two trailers without collecting prohibitions.

He would be prepared to reconsider the application towards the end of April, provided there was a satisfactory maintenance investigation and Francis did not collect any further prohibitions.
