In evidence, Mr Philliskirk agreed that Mr Monkhouse only spent two hours per week with him, saying the arrangement was that he would do so until he had obtained his own certificate of competence. He had failed the examination last October, and both he and his wife were sitting again in March.

He had formerly been employed as a driver by Eddie Stobbart Ltd and Mr Stobbart had agreed to act as his transport manager when he got his own vehicle but later realised he could not act for two firms.

After Mr Foy said the applicant had a conviction for drivers hours offences and further action on similar offences was under consideration Mr Philliskirk said that he now had an arrangement with another driver to bring his vehicle in if his hours ran out.

The DLA said he did not like such arrangements as it could. lead to further offences.

Following undertakings concerning keeping within the regulations Mr Kelly said he proposed to adjourn the hearing and continue the interim licence until after the results of the March examination were known. If there was no success there could be no further extension of the interim.
