• Former owner driver Robert Twinning has blamed his maintenance problems on his employment of other drivers.

Michael Carless said this for Twinning, who trades as Atherstone Hire, while appearing at a Birmingham disciplinary inquiry after two prohibition notices were imposed on Twinning's vehicles.

At the inquiry, West Midland Deputy Traffic Commissioner Roger Seymour considered, but then ruled out, taking action against Twinning's three-vehicle licence.

Carless said the prohibition notice issued in May was marked neglect and since then the period between inspections had been reduced to three weeks Twinning said he had two vehicles on contract with Tarmac Roadstone and they had not been any problem. The vehicle given the prohibitions was engaged on heavy site work. His drivers were now required to fill in their daily defect reports either in the presence of himself or his wife.

The prohibited vehicle had turned over on the motorway at the end of April. It was given a new cab and the chassis was realigned.

The vehicle examiner found the propshaft bolts to be loose. The commercial garage which carried out the repairs had not fitted new propshaft bolts on realignment of the chassis, which he would have expected it to do.

'The driver had been dismissed because wheelnuts were found to be loose. Each vehicle had a wheelbrace for checking the wheelnuts and the driver had lost it. The vehicle examiner had said the defective tyre was a borderline case, and that if it had been a dry day it would not have been a prohibition item.

He had said that for its age, the vehicle was in very good condition. Because of the prohibition, Twinning sacked his fitter.

Taking no action, Seymour warned Twinning of the consequences of any further problems.
