Which of the following most accurately describes the problem?

• Halifax-based TI! Holroyd has succeeded in having £.400 cut from a £1,000 fine for using a dangerous tyre which was said to be only a minor danger to the public.

For the Department of Transport John Heaton told the appeal court at Bolton that a vehicle towing a trailer was stopped at Thornham Island, Rochdale.

On inspection, it was found that one tyre on the trailer's nearside front axle was oversized and consequently the tyre was rubbing on part of the chassis. If the vehicle had been allowed to continue, it was likely that the tyre would have burst, throwing the vehicle out of control.

For the company, John Naughton said the trailer was one of two owned by the company, the other trailer being larger. In error, the spare wheel for the larger trailer had been fitted to the smaller trailer.

The trailer was only moved once or twice a month from site to site so there could have been only a minor danger to the public. The sentence imposed by Rochdale magistrates was far too severe as the company had fully accepted its responsibility, pleading guilty by letter at the first opportunity Judge Brian Carter QC said he did not know what the magistrates had been told by the company in their letter, but considering all the circumstances the fine would be reduced. He directed that £100 of defence costs be paid out of public funds
