• Hamilton-based David Weir has been penalised for forgetting to renew his licence by it being granted a licence for vehicles in possession only.

Weir, who trades as JY Weir & Co, previously held a licence authorising 20 vehicles and four trailers. He applied for a new licence for 10 vehicles and five trailers. Scottish Traffic Conurnssioner Michael Betts granted a licence for the five vehicles and three trailers in possession.

Weir told the commissioner that he applied for a new licence in July after his administrative system fell apart and he overlooked the renewal date of the licence. He agreed that he had continued operating after his previous licerx.e had lapsed.

Walter Brown, of the DOT Vehicle Inspectorate, said two prohibitions for defective loadsensing valves had been issued during a maintenance investigation in August. The semi-trailer of an articulated outfit stopped in a roadside check was found to have its handbrake disconnected.

He agreed with Michael Whiteford, for VVeir, that there was no danger while the trailer remained coupled to the tractor.

Brown pointed out that Weir had undertaken to have his fleet checked annually by the Freight Transport Association when he appeared at disciplinary proceedings in 1990. The contract with the FTA had run until October
