Which of the following most accurately describes the problem?

• Mr Jon Tempalski, whose licence was revoked by the Eastern deputy LA last September, successfully applied for a new 0 licence last week.

Following a history of GV9s and convictions relating to the use of two vehicles the deputy LA, Mr Gerald Kidner, told him at a public inquiry on September 25 that he was sorry to have to do so but he had little option but to revoke the licence. At that time it was pleaded on Mr Tempalski's behalf that he understood little English and could not cope with the regulations governing the operation of his vehicles. He was advised that it would be wise to take a partner to handle the "paperwork".

Last week, through a solicitor, Mr Tempalski, of Tiptree, Essex, told Mr Kidner that he had now entered a partnership agreement with his father-in-law who had considerable experience in transport. The partnership would trade as F. R. Cole and J. Tempalski and Mr Cole would be responsible for inspection of vehicles and manage all records. A garage would be employed for major maintenance.

During the hearing the application for four vehicles and three trailers was amended to one vehicle only.

The application was allowed after Mr Kidner had issued a strong warning that he regarded the firm as being on probation.
