Stoke-on-Trent-based William Heath, trading as Cauldron Traction Services, holds a licence for three vehicles and five trailers. Vehicle examiner Harry Marsh said he had inspected two vehicles in June, issuing two inspection notices and one immediate S-marked prohibition for a long-standing brake defect.

The prohibited vehicle had only been inspected three days before; its safety inspection record showed no work was required on the brakes. Inspection records and some driver defect reports were not properly completed.The initial pass rate at annual test was 0%, compared with the national average of 66%.

Heath had moved to his own maintenance facilities at Doveridge.Derbs,andinAugust he had contracted a consultant engineer to oversee his vehicle maintenance. He felt the examiner's report was "a little over the top".

Appearing for Heath,Graham Howard maintained that vehicle maintenance was now far better than it had ever been.

The Deputy TC is to issue his decision in writing.
