Which of the following most accurately describes the problem?

Ar Birmingham on Tuesday the West Midland Traffic Commissioners granted Berresford's Motors Ltd. an express service from Leek to carry customers of Horizon (Midlands) Ltd. bound for Continental holidays from Elmdon Airport, Birmingham. The service was authorized to operate on Fridays, Saturdays and Sundays between April and September with a single-deck bus.

The chairman, Mr. John Else, stipulated that the service must not be run with less than five passengers. The vehicle allowance authorized was one.

When Mr. D. Skelding, for Berresford's, told the court that Horizon had offered Berresford's ,E12 return for the 135-mile round trip with picking-up points at Hanley, Wolverhampton and Birmingham, Mr. Else said this gave a return of approximately ls. 9-1-d. per mile, which he did not consider sufficient. Eatonways Luxury Travel Ltd. objected to the Birmingham picking-up point as they already operated a daily service to the airport from Birmingham. Berresford's then withdrew that point.

During a short adjournment Berresford's and Horizon agreed on a £14 return charge, giving a return of 2s. Id. per mile, with the withdrawal of the Birmingham picking-up point reducing the mileage.
