Running parallel to the new offence of corporate manslaughter is the Health & Safety (Offences) Act 2008, which comes into force in January This increases the penalties available for most summary offences from £5,000 to £20,000, and carries custodial sentences of up to 12 months.
The increased penalties reinforce the need for businesses to consider the benef its of trading as a limited company, so that if any prosecution takes place it is most likely to be brought against the limited company and not the sole trader, partner or owner personally.
