Which of the following most accurately describes the problem?

SIX DRIVERS from collapsed haulier Stoford Transport have failed to win redundancy and back pay from the company that took over much of its business.

An Employment Tribunal heard the drivers were laid off in November even though Stoford's pallet operation continued on its site near Cullompton in Devon under the name Pall-Ex South-West.

United Road Transport Union regional officer Malcolm Williams. who represented the drivers, says: "The drivers claimed they should have been transferred to Pall-Ex because of the amount of work they were involved in that is now handled by the new company."

Roger Tancock, director of PallEx South-West, says his company was freed of all employee claims at the two-day hearing.

The Department for Trade & Industry will now meet the drivers' redundancy and wage claim, but they receive considerably less than if Pall-Ex had been liable. This is because DTI awards are based on maximum weekly earnings of f270 and the drivers were earning around L320 a week.
