AN OWNER-DRIVER who claimed he was using his vehicle without licence authority to obtain sufficient money to apply for an 0-licence has lost his bid to have it returned after it was impounded by VOSA.
In seeking its return, Damien McNiffe, of Cannon Place, South-East London, admitted that he had no 0-licence, saying that he had just got the truck tested and he was working it to save money for an 0-licence. He had now asked for an application form.The truck was the only means of supporting his family.
In refusing to return the vehicle, the South Eastern & Metropolitan Traffic Commissioner Christopher Heaps said the loaded vehicle was impounded after it was stopped at the Wandsworth police check point. The vehicle was given a delayed prohibition in respect of an excessively worn suspension slipper bracket. When interviewed by a traffic examiner, McNiffe had admitted that he knew that he should have had a licence as he had been reported previously for operating without an 0-licence.
Given McNiffe's awareness of licensing requirements there were no grounds for the return of the vehicle.
