Hristov Stavanov Hristo, of Claymore Road, Moy, pleaded guilty to an offence of falsification and to taking insufficient daily rest. His employer was not charged with any offence and did not appear at the hearing. Prosecuting for VOSA, John Heaton said that a 40-tonne artic laden with cartons and driven by Hristo was stopped in a check at Cuerden, Preston, in January. The tachograph records revealed that five kilometres were missing from one chart and that another showed there had been only seven hours 40 mins daily rest in a 24-hour period.

Hristo said that the offences were his fault, But he added: "Everyone knows it, it is a question of the company which asks the driver, they always push us to drive. All the fault after that is up to us. It's the reason for the time," said Hristo.

"If! want to keep my job! have to do it sometimes, We are foreigners and do not have much choice.1 am jobless at the moment. I have no benefits,! quit the job because the company did not pay me the last few weeks' wages. I cannot claim benefits because my wife works full-time. If !don't get a job soon I will go home to Bulgaria."

Hristo was fined £220 and £120 prosecution costs.
