AFOUR-VEHICLE Contract A to A licence switch granted to Transport Services (Newbury) Ltd. by the South Eastern deputy Licensing Authority has been reversed by the Transport Tribunal. The appellants were BRS, BR, G. Cannon and Sons Ltd., Ameys Transport (Oxford) Ltd., and Ameys Transport (Reading) Ltd. (COMMERCIAL MOTOR, July 14).

The Tribunal rejects the LA's view that the application on its merits was indistinguishable from the Jeory case. The Contract A licence work done by Transport Services (Newbury) Ltd. for Florco Ltd., of Thatcham, Berks., was inherently unprofitable. "Florco Ltd. required their goods to be carried to a variety of destinations all over England and Wales, but the quantities were often very small, sometimes only a single roll of floor-cloth to a particular town. In the aggregate the outward loads only amounted to about 50 per cent of the capacity of the vehicles, while the return loads only filled about 20 per cent of the capacity of the vehicles."

The Tribunal judgment continues: "In these circumstances one can readily see why the respondents were anxious to be put into the position of being able to eliminate or reduce the underemployment of their vehicles by carrying goods for other customers. It is not, however, the function of the licensing system to rescue hauliers from the consequences of their improvident contracts".

Allowing the appeal, the Tribunal says its decision will not take effect until September 30, 1967, to give Florco Ltd. an opportunity of making alternative arrangements.
