13alvinder Singh, trading as GSD Haulage, appeared before West Midland Traffic Commissioner John Mervyn Pugh, following the issue of a prohibition notice for defective brakes to a vehicle involved in an accident. Singh said that he purchased the vehicle on 17 July and the accident occurred on 7 August. It had its MOT test on 3 June and the driver had not reported anything wrong. He had bought the vehicle in good faith from an owner-driver who worked for the same people as he did. It had been booked in for inspection on the Saturday and the accident occurred on the Wednesday.

Mervyn Pugh commented that had Singh attended a new operator's seminar lie would have been advised that if he bought a second-hand vehicle he must insist that it have a fresh MOT test.

For Singh, Michael Carless said that he had held a previous licence without any problems. The system of maintenance recommended in the West Midlands had been put in place following the vehicle examiner's visit in September.

Indicating that he would be prepared to consider increasing the authorisation to four vehicles in six months time if there were no further prohibitions, Mervyn Pugh warned that there would be a further maintenance investigation at some stage.
