An• Magistrates did not endorse the WV driving licences of Stockport haulier Raimo Allen, and one of his drivers, despite convicting them of using a vehicle with defective brakes.

Allen, who trades as L & M Allen, of Bredbury, Stockport, and Anthony Ray pleaded not guilty to the charges.

Vehicle examiner Geoffrey Davison said that in February a Foclen 38-tonne artic with a triaxle tipping trailer was stopped in a check on the A6.

An examination revealed that the brakes on the rear trailer axle were not working. He issued an immediate prohibition and the vehicle was taken to the test station after being repaired at the roadside.

He agreed with Jonathan Lawton, defending, that no rolling road brake test had been carried out.

Ray said that he had been driving for Allen for five years. He was told to notify Allen at the first sign of any trouble. He had not noticed anything wrong with the brakes on the day concerned.

Lawton said that Allen employed two fitters and had his vehicles inspected every fortnight. Allen told the magistrates that he was spending £11,000 a month on maintaining his 16 vehicles and 10 trailers.

The magistrates found the case proved, fining Allen £250 and Ray .C100. They also ordered Allen to pay £130 prosecution costs.
