AN OWNER-DRIVER was given a second chance by Senior Traffic Commissioner Philip Brown at a public inquiry in Bristol after operating without a transport manager for almost two years.

David John Helyar of Thatcham, who has held an 0licence for one vehicle for three year was investigated by Vosa following a collision in June 2006. Vehicle examiner Ben Matthews checked Helyar's truck in September 2006 and issued an immediate prohibition for two defective and corroded brakes on the drive axles. Matthews believed the problems were long-standing. The maintenance schedule had not been adhered to. In March 2007 Matthews inspected Helyar's new truck only to issue a delayed prohibition for a worn suspension pin bush.

Helyar accepted full responsibility for breaching the undertakings that supported his 0-licence. He said he had completed good daily checks and always spent money as necessary on the truck. However, he had now changed his maintenance contract to the RMC workshop.

"Gary Smith agreed to be my transport manager for the first year and did that. I haven't had anyone since,he told the TC, who replied: "You had no transport manager for almost two years-no wonder things went wrong."! lelyar said he has now contacted a CPC holder about taking daily responsibility.

TheTC concluded that Helyar had not lost his repute and was still of good financial standing, but without a transport manager could not be found professionally competent and so the licence must be revoked. In light of Helyar's full acceptance of responsibility he delayed the revocation until 21 July 2007 to allow a fresh application as long as Helyar supplied details of his maintenance contract and CPC holder within seven days.
