Jean Pierre Caubet, Gerard Marcel Venon and Didier Lucien Poupee all admitted failing to take sufficient daily rest. In addition Poupee admitted exceeding the daily driving period.

Prosecuting for the DOT, John Heaton said that all three men were driving maximum capacity 38-tonne artics when checked by traffic examiners.

An examination of Caubet's and VenonS tachograph charts on 22 June showed that the previous day they had both only had

six hours 40 minutes rest.

On 20 June Venon drove from France to Manchester, some 673km, driving at high speeds on motorways for the majority of his journey. He had taken a grossly inadequate rest period.

Poupee was stopped on 2 July. His charts showed that on 29 and 30 June he had driven from France to Manchester, some 750km, driving for 12 hours and 10 mins.

The maximum period of unbroken rest was four hours, and that rest period had been taken when on the cross channel ferry. Poupee had been behind the wheel of a 38-tonne vehicle, driving at high speeds for long periods, with serious safety implications, said Heaton.
