I am a non-ADR owner-driver and a customer has asked me to deliver full loads of waterbased paint in 205-litre drums. I cannot find out if this product is covered by the ADR regulations and whether I can legally carry it. Can you advise please? Name and address supplied Lancashire
The rules governing the transportation of dangerous goods place responsibilities on both the consignor of the goods and the haulier. The consignor is primarily responsible for the classification, packaging and labelling of the product and must provide the transporter with information about the load.
If your customer has no information to provide you it may be that the paint is not deemed hazardous enough to be covered by the ADR rules. Even if your customer does not provide any information you still have a responsibility to ensure that the law is complied with. If you do not receive any information I would advise that you try and find out the ingredients in the paint (as well as quantities) and then check them against the official lists of dangerous goods as published by the Health & Safety Executive.
