THE Transport Tribunal in Edinburgh on Tuesday rejected an appeal by

• George Tait and Son Ltd against the refusal of the Scottish Licensing Authority to permit conversion of 12 vehicles on Contract A to open A. Tait and Son is one firm in .a group of 12 and operates as transport manager for the firms in the group. The respondents. British Railways and Dobson (Edinburgh) Ltd„ contended that the Authority was correct in deciding that this was not a ease for an A licence, there being only one customer involved.

Refusing the appeal, the Tribunal said the appellants originally held an open A licence for two vehicles and also • operated 12 other vehicles on Contract A for E. Chalmers and Co. Ltd. The relationship between these firms was not clear, but was very close, and the same directors gave evidence for both appellants and their customer, The reason advanced for the proposed variation from Contract A to A was greater flexibility, if all vehicles were on the same licence. It was stated that, if granted, all 12 vehicles would in future carry outward goods for E. Chalmers and Co. Having regard to the relationship, this was not a proper case for the grant of an A licence, said the Tribunal. If a licence other than a Contract A applied it should be a B licence in view of the principles laid down by the Court of Appeal. The Licensing Authority had had that point in mind and was right to refuse the application.
