THE HEALTH and Safety Executive (HSE) is warning all operators to check that their drivers are properly trained after a local authority was prosecuted when a truck overturned and landed on its driver.

Stockport Metropolitan Borough Council was fined £6,000 with more than £3,000 costs after pleading guilty to breaching health and safety legislation.

Trafford Magistrate's Court heard how Simon Nicoll,a dumper truck driver for the authority. suffered leg injuries when his vehicle overturned and fell on him as he carried out landscaping work in Hollywood Park, Stockport in February 2006.

HSE inspector Helen Fuller says:"Anyone involved with workplace transport should be aware of the operational limitations associated with the use of plant and should not underestimate the risks of improper equipment use.

"Employers have a duty of care to ensure that drivers are suitably trained, risks are assessed when planning work and adequate safety measures are in place."

A council spokesman says:"This was an unfortunate one-off incident which occurred after a temporary driver had replaced the usual driver who was off work through illness on the day."

But he concludes: We carried out a full internal investigation and have put many preventive measures into place."
