MD CONSTRUCTION (Scotland) had its licence revoked when it failed to turn up at a public inquiry held to investigate maintenance problems and the use of an unauthorised operating centre.

An earlier inquiry had been adjourned at the company's request when its director George Davren wrote to say he would be on holiday. He requested a new date but did not turn up to that inquiry either.

The Airdrie-based company had been called before Scottish Traffic Commissioner Joan Aitken at an Edinburgh disciplinary inquiry; it held a two-vehicle restricted licence.

The TC was told that a maintenance investigation had been carried out in February.The driver's defectreporting system was inadequate; safety inspections were not being carried out at the stated intervals; the specified maintenance contractors were no longer being used; the operating centre had been changed without authority; and two S-marked immediate prohibitions had been issued in November.

Revoking the licence, the TC said it was clear that undertakings to keep vehicles serviceable and operate a drivers' defect-reporting system had been breached. There were no records to prove that the preventive maintenance inspections were being made at the promised intervals.

The company had failed to make an application to change its operating centre so it was operating from an unauthorised operating centre.
