Which of the following most accurately describes the problem?

• Both Anthony and David Bayliss, trading as Bayliss Transport, and Basingstoke & Deane Borough Council, have lost appeals against conditions imposed on the firm's licence restricting the hours of operation at its operating centre at Huttons Yard, Frog Lane, Mapledurwell, Basingstoke.

Western Deputy Licensing Authority John Robins had granted the company's application for a licence for 25 vehicles and 16 trailers with two environmental conditions.

At appeal, the tribunal said that it was a particularly difficult case. A suggested total ban on movements between 19:00 and 07:00hrs would have meant the loss of a contract with Henkel which required two artics to leave at about 04:00hrs. Its loss would have put the firm out of business. The firm's initial request for unrestricted 24 hour operation would have made life wholly intolerable for neighbouring residents. The tribunal felt that the DLA's approach could not be faulted. It felt that not only was there no proper basis on which to alter the evening "cutoff" period from 20:00hrs to 22:00hrs, but that there was a very real risk that such a change would destroy the overall balance the DLA had taken such trouble to achieve.

Dismissing the appeals, it said the DLA's task was to strike a balance between an efficient transport industry and the needs of local people. In this he couldn't be faulted.
