TC shows clemency towards operator

A DERBYSHIRE HAULIER who transported a trailer in a "disgraceful" condition, and who claimed he did not know his transport manager had died has had his licence suspended for a fortnight.

North Western Deputy Traffic Commissioner Mark Hinchliffe granted an application by the Chesterfield-based Michael Watson, trading as M J Watson Haulage, to reduce his licence from five vehicles and five trailers to two vehicles and two trailers at a new operating centre.

Vehicle examiner Cameron Smith said that he carried out a maintenance investigation in October following the issue of an `S' marked prohibition to a trailer in poor condition, which had rolled over in September. There were no inspection records available for the trailer concerned, and he was told it had been on hire to another operator. It was being taken for scrap when the accident happened. The initial pass rate at annual test was 27.78%, with some vehicles failing on a number of occasions, and there was a catalogue of prohibitions.

Watson said the trailer, which was damaged, had been parked up since December 2006. He was given very short notice to quit his operating centre and he was stupidly moving the trailer about a mile so that it could be cut up.

He agreed he had not notified the TC that his transport manager had died and that he had moved operating centre. He said that he had been abroad and had not known that his transport manager had died for some time.

Watson intended to study for his on CPC, but, in the mean time, had a part-time transport manager standing by.

Hinchliffe said that in all his years as TC, this was the first time an operator had said he did not know that his transport manager had died.

The trailer had been in a disgraceful condition and it was fortunate there had been no injury or loss of life.
