More Operator's Licences will be at risk of revocation after 1 October as changes to the rules governing Traffic Commissioners' treatment of hauliers convicted of road traffic offences come into force. From the beginning of next month, hauliers will not only face more stringent financial requirements, but also changes to the regulations governing their good repute, according to Senior Traffic Commissioner Michael Betts.

Currently, Schedule 3 of the Goods Vehicles {Licensing of Operators) Act 1995 says that an operator no longer meets the requirement to be of good repute if he has repeatedly been convicted of road transport offences-. In the past this was generally taken to mean on more than one occasion.

However, from 1 October the word repeatedly" is being removed from the regulations. That will bring an operator's repute into question if he is convicted of a number of offences on the same day, Betts warns.

The IC's comments came during a Dumfries disciplinary inquiry when Alasdair and Andrew Scott. trading as Alex Scott & Son, appeared before him because of concern over a number of convictions recorded against the firm and its drivers.

Betts suspended one of the firm's vehicles for a month but commented that if he heard a similar case after 1 October he might have decided the company no longer met the requirement of good repute and revoked its licence.
