Tribunal Lifts Deputy TC's restrictions
AN OPERATOR has won its appeal against restrictions on the movement and weight of vehicles from its operating centre after the Transport Tribunal ruled that those restrictions would increase truck movements.
Greaves Surveying & Engineering had applied to operate four vehicles and two trailers from Lenham Heath. Kent. South-Eastern Deputy Traffic Commissioner Christopher Heaps had granted the vehicles but not the trailers.
He had imposed conditions restricting the hours of operation to 7am to 6prn Monday to Friday with no movements at weekends and on bank and public holidays, and limiting the vehicles to a maximum of 12.5 tonnes ('Residents block operator's site application', CM 1 May).
The Tribunal heard that the proposed weight restriction combined with the inability to operate trailers would have serious implications for the business as it would mean larger vehicles and trailers having to be operated from alternative sites. The increased use of subcontractors would also have to be considered. There would be an increased number of vehicle movements as a result of the larger vehicles having to visit the site.
The Tribunal allowed two vehicles not to exceed 12.5 tonnes gross, two rigid vehicles not to exceed 26 tonnes gross and two drawbar trailers. It imposed conditions including: • Authorised vehicles would not operate from the site except between 6.30am and 6.30pm Monday to Friday; between 8.30am and 2,30pm on Saturdays; and between 2pm and 8pm on Sundays.
• There would be no authorised vehicle movements from 8ain to 8.30am and 3.30pm to 4.30pm Monday to Friday during school term times.
• The company would undertake to restrict the number of authorised daily vehicle movements to four in and four out on Mondays to Fridays, one in and one out on Saturdays and Sundays, and none on bank and public holidays.
