Which of the following most accurately describes the problem?

• David Doig, of Musselburgh. was granted an 0 licence for one vehicle for two years and a B licence for a 64-ton flat at Edinburgh on Monday by the Scottish LA, Mr A. B. Birnie.

Mr Doig said he was a driver of considerable experience who had driven for Charles and Co (Leith) Ltd, grain and fertilizer merchants, for some years; he proposed to operate his own vehicle, doing some 75 per cent of operating work for that firm, which supported the application conditioned "agricultural goods and requisites within 100 miles of base".

Because of reduced drivers' hours, the company was having difficulty in meeting deliveries, Mr R: Cumming, director of Charles, told the LA. It operated two vehicles of its own and used experienced grain haulage firms continuously but could utilize Mr Doig's services perhaps 80 per cent of his available time. Mr Doig knew the farmers concerned—which was essential in this trade.

British Railways objected and a compromise was agreed whereby the normal user was amended to "Goods for Thomas Bernard within 50 miles for Charles and Co (Leith) Ltd within 120 miles with extensions to Preston and Liverpool."
