A LEOMINSTER haulier has lost his appeal against the refusal of the West MidIan d Traffic Commissioner David Dixon to increase the authorisation on his firm's licence from four vehicles to six,and to upgrade it to an international licence.

The refusal hinged on the company's inability to supply a copy of an overdraft agreement proving financial standing. Instead, the company could only provide an e-mail from the operator's bank, stating that the money would be available if required.

After Russell Price and Michael Perry, trading as Village Green Motor Services, applied for the increase,thc Traffic Area Office wrote to say the financial information provided was insufficient and the firm needed to show that 1:23,2(X) had been available during the preceding three months. The firm was invited to provide hank statements for that period.

Perry supplied bank statements and said an e-mail was being sent from HSBC confirming that an overdraft facility of £25,000 was available to the firm. He added that it owned eight vehicles and operated from freehold-owned property. Subsequently, an e-mail from HSBC confirmed that the firm would have had access to an overdraft facility of £25,000.

'the TAO told Perry it could only accept an original overdraft agreement and its current overdraft agreement was insufficient. A deadline of 10 October was imposed; on 11 October the TAO stated the deadline had expired and the application had been refused.

Perry wrote the same day,asking for a meeting with the 'IC. The TAO replied that the TC's decision had been made and a meeting was not possible.
