• Criticism of WJ Capper Transport's maintenance system by a DOT Vehicle Inspectorate district manager was attacked as unfair at a Birmingham public inquiry.
The Telford-based company holds a licence for 10 vehicles and 20 trailers. It had been called to disciplinary proceedings before West Midland Li censing Authority John Mervyn Pugh.
For the company, Michael Carless said that when the licence was renewed a vehicle examiner had been satisfied with the company's maintenance and he had intimated that he had not changed his opinion since. None of the four prohibitions was endorsed "neglect".
Carless said that he had reached the conclusion against the evidence of the man who had carried out the fleet inspection. There was nothing really wrong and the district manager's verdict was unfair.
Mervyn Pugh cut the duration of the licence to June 1994.
