TIMBER CARRYING trailers require sideguards unless specially constructed or adapted for the carriage of timber of exceptional lengths, a Scottish court has held.

John Keith, trading as Keith of Denny, of Drum Farm, Denny, near Stirling, pleaded not guilty to using a trailer not equipped with sideguards before Perth Sheriff's court. He pleaded guilty to exceeding the train weight of the vehicle, as did the driver, Mr Keith's son, John.

Evidence was given by traffic examiner Michael Clinton that the articulated outfit had been stopped in a weight check and found to weigh just under 40 tonnes. The trailer was a 40ft Craven Tasker semi-trailer, equipped with bolsters and stanchions and it was carrying round timber.

The defence argued that the outfit was entitled to the exemption to the sideguards regulations for vehicles constructed or adapted for the carriage of round timber or beams, being items of exceptional length.

Sheriff Isobel Poole disagreed, but adjourned the question of penalty until March 18,
