Wyvern Cargo, of Poole, part of the ANC Express Group, has had the duration of its licence cut following breaches of environmental conditions at its Southampton depot. The licence now expires at the end of June.

Western Deputy Traffic Commissioner John Stevenson said the conditions he initially imposed were too severe. He has now varied them—but not to the extent requested by the company.

Following complaints about Wyvern vehicles obstructing the access road on the Empress Park Industrial Estate, the DeputyTC said that vehicles should not be parked for any purpose at any time on the access road serving and forming part of the Empress Park Industrial estate, nor in Empress Road within 250m from the access to the estate.

When the case came before the Deputy Tc in March (CM 1-7 April), Southampton depot director Colin Hawkins said it was impossible to comply with the conditions. As a consequence, Wyvern Cargo sought to have the

access road condition changed so that no vehicle would block the access road, except for fuelling The company also wanted vehicles to wait for up to 20 minutes on the part of the access road at the front of Wyvern's premises.

However, Stevenson did not feel that the phrase "will not normally last longer than 20 minutes" was sufficiently clear. He also believed that to vary the conditions in the way asked would reduce the width of the access road by half.

The aim of the conditions was to prevent the use of the access road as an alternative parking area, said Stevenson.

Curtailing the licence duration, he said that the company admitted breaching the conditions. Nobody could have been in any doubt about their meaning Though there had been the diesel pump problem, a number of the breaches had nothing to do with fuelling.

Stevenson warned that if vehicles were parked on the access road, it would bring the suitability of the operating centre into question.
