Which of the following most accurately describes the problem?

ASUGGESTION that children injured on the roads should always be compensated, either through insurers or the State, whether the drivers concerned were negligent or not. was made by Mr. Justice Finnemore at Birmingham Assizes.

A claim for damages against Birmingham Corporation had been brought on behalf of Cynthia Stephens, aged 10, 139 May Lane, King's Heath, who was knocked down by a Corporation bus. Her left leg had to be amputated.

The corporation denied liability and Mr. Justice Finnemore dismissed the claim, holding that the bus driver had not been negligent. He said it was inevitable that children going to and from school were not going to show the same judgment which older people could.
