A DUTCH truck driver has escaped with a £2,000 fine for his part in a fatal road accident, despite being over his hours limits.

When Huig Ouweh and appeared before Sudbury !Magistrates Court he was found guilty of careless driving, driving in excess of the maximum driving hours and failing to take the required daily rest.

The court heard that Ouwehand's drawbar rig clipped a car after he changed lanes on the Al 4 at Exning, near Newmarket and sent it careering into the back of a stationary truck. The car driver, Kristopher Tott, died in hospital eight days later.

Ouwehand failed to stop after the accident; the mag istrates said they could not be sure he was aware of hitting the other vehicle.

Witnesses spotted part of Ouwehand's number plate and police launched a multi-agency probe to track him down.They were waiting for him at Harwich the next time he entered the UK.

Investigations revealed that when Ouwehand arrived at various delivery addresses in the UK he had unloaded his truck himself instead of taking his breaks.

Ouwehand was fined £.1,600 for driving without due care, £200 for failing to take a rest the night before the accident, and £200 for exceeding his 10 hours driving limit.

He plans to appeal against the sentence and the conviction — a decision that has outraged lbtt's family. His father describes the move as "disgusting".
