COMPANY DIRECTOR Tony Bragg has been disqualified for five years and had his licence revoked for breaches of hours regulations and failing to employ a transport manager.

Maryport, Cumbria-based R&H Haulage, which was appearing before North-Western TC Beverley Bell, held a licence for four vehicles and four trailers and had applied to increase the authorisation to 10 vehicles and 10 trailers.

Evidence was given about prohibition notices imposed on vehicles and breaches of drivers' hours and tachograph rules by drivers. The nominated transport manager had not been employed for some time and no notification had been given about a change of directorship.The company had failed to tile accounts with Companies House as required.

Making the revocation and disqualification orders, the TC said she had concluded that the licence had been hijacked by Tony Bragg with the express intention of circumventing orders made for the revocation of the licence held by Tibs Light Haulage and its disqualification from holding a licence. He had used the vehicles of R&H Haulage to continue operating. Bragg was a major player and had controlled the company. The breaches were serious and had a real impact on road safety.

Time had been allowed for the company to produce accounts, but none had been forthcoming.

At some stage a Velma Hinkson had invested in the company and if she decided she wanted to stay in the transport industry there was no bar on her applying for an 0-licence.
