Which of the following most accurately describes the problem?

• The Transport Tribunal granted the appeal of Kenneth F. King (Transport) Ltd., of Littleport, after the respondents Knowles (Transport) Ltd. and seven others had decided not to contest the appeal. The hearing took place in London on Thursday of last week.

For the appellant company, Mr. 0. Popplewell said that Mr. King had been trading under his own name with two A-licensed vehicles, three B-licensed vehicles and two vehicles on A contract licence. He had formed a limited company and applied in the name of that company for his two A licences and a further A licence for those two vehicles previously on A contract. Had the application been granted, said Mr. Popplewell, the A contract licence would have been surrendered.

At the public inquiry on May 23 the Eastern deputy LA had granted an A licence for only two vehicles with the condition that the A contract licence be surrendered. The reason given for the relatively small size of the grant was that there was not evidence of enough work for four vehicles.

Mr. Popplewell, however, contested this finding and pointed out to the Tribunal that the figures produced at the inquiry indicated a slight increase in earnings per vehicle in the first part of 1968. Mr. C. R. Kaile, for the respondents, said that it would have been wrong for him to suggest that the surrender of the A contract licence was necessary on the strength of the figures produced, and the respondents would not in fact contest the appeal.

Mr. G. D. Squibb, QC, president of the Tribunal, upheld the appeal, considering the grant of two vehicles in place of the four applied for "wholly inadequate"; the decision of the deputy LA will therefore be amended by the deletion of the reference to the surrender of the A contract licence.
