ANOTHER case concerning an increase in unladen, was adjourned by Mr. J. A.T. Hanlon, Northern Licensing Authority,. Newcastle upon Tyne„ to allowa representative of K. and B. Motors, Ltd., to give evidence. S. and J. Wanless, Haltwhistle, applied for an ordinary A licence on the expiry of a special A licence for a vehicle bought last May. The lorry was purchased from K. and B. Motors, Ltd.,. and unladen weight was given as 2 tons 17 cwt. When it was weighed last • December it was found to be heavier, and the application gave the weight as 31 tons. Mr. T. H. Campbell Wardlaw, for the applicants, said all formalities concerning the licence had been left to K. and B. Motors. The only alterations made to the vehicle after purchase had been the fitting of heavier tyres and sideboards. The sideboards had since been removed. Mr. Sidney Wanless said he bought the vehicle to carry lime in connection with his business as an agricultural contractor, not knowing that he could not carry his own goods in it.

FAMILY ARGUE OVER CONTRACT LICENCES

ALLEGATIONS, on behalf of F. 1-1 Hesford and Sons, Ltd., that after the sale of the shares of a company, formerly held by Mr. and Mrs. F. Hesford, traffic was abstracted by their son, Mr. D. Hesford, by putting six vehicles on contract-A licence with two of the main customers, were made before Mr. F. Williamson, North Western Licensing Authority, at Manchester last week, when Mr. D. Hesford applied for a new B licence. Mr. D. Hesford told the Authority that one of two tippers on contract to his father was carrying slurry to the brickworks of J. and A. Jackson. Leigh. During the summer months Jackson's required the carriage of bricks to the Widnes area. 'These could be put on this vehicle as return loads. . Questioned by Mr. P. Kershaw, for F. Hesford and Sons, Ltd., he agreed that he was driving for the company when the shares were transferred and. shortly afterwards set up on his own with six vehicles on contract A to his father and Thos. Mosdale, two of the main customers. Mr. F. Hesford said that he stopped using his old company to carry slurry because they provided ramshackle vehicles. He finally dispensed with their services in 1957. He had received money in consideration of goodwill but that was seven years ago. Mr. Kershaw submitted that F. Hesford and Sons, Ltd., had 13 B-licensed vehicles and were prepared to provide at least one tipper whenever Jacksons required it. No complaints had ever been received from Mr. Hesford about vehicles, and, in fact, a new tipper was in use for the slurry work when it was stopped.

The application was refused.
