In the chicle examiner's opinion this presented a hazard. He said the defect would have been present before the vehicle's first journey of the day and would have been obvious to the driver during a daily walk-round check. Kumar told the examiner: "Yes. that is my mistake." An immediate prohibition notice was issued.

Grewal said the driver had not told him of the damage; if he had been told, he would not have allowed him to take the vehicle on the road.

Grewal was fined £400 with £300 costs; Kumar was fined £200.

District Judge Barnes said the offences were serious. It was Grewal's responsibility, his business and his vehicle — and he had a responsibility to ensure the vehicle was in a proper condition on public roads. This was a big vehicle and there was serious danger if it was not kept in a safe and proper condition.
