Which of the following most accurately describes the problem?

On 11 April the current European regulation on EU drivers' hours rules (3820/85), which has been in force for more than 20 years, will be replaced by regulation 561/2006.

Why change?

The rules contain concessions for certain specialised vehicles and operations, exempting their drivers from the EU regulations. The EU wanted to update the lists of out-of-scope vehicles to reflect developments in the road transport sector since the original legislation was written in the mid-1980s.

Most vehicle types currently in or out of scope remain unaffected by the changes the fundamental thresholds still apply to vehicles over 3.5 tonnes and PVCs with more than nine seats.

Who is affected?

These changes may affect operators running the following vehicles/ operating in the following sectors: • Minibuses • Recovery vehicles • Utilities, refuse collection and public bodies • Non-commercial carriage of goods • Agriculture • Postal services • Specially fitted vehicles • Vehicles powered by gas or electricity • Military/emergency services • Showman's vehicles

Managing the change

the implications for operations losing a concession are significant: the drivers of these vehicles are also likely to be subject to the road transport working time rules for the first time. Operators losing concessions should: • Understand the new EU drivers' hours rules and any changes to working time • Re-assess and re-plan schedules • Speak to affected customers and negotiate any changes to contracts • Speak to affected staff and negotiate any changes to contracts of employment or working practices • Arrange to amend planning and analysis systems II Provide training for drivers and other affected staff • Have tachographs fitted to affected vehicles by the end of the year
