Which of the following most accurately describes the problem?

Disciplinary proceedings involving Widnes international haulier Eugene Marsh have been adjourned pending an investigation into the taxation of four vehicles. Marsh, trading as JK Transport, had been called before North Western Traffic Commissioner Beverley Bell at a Wigan disciplinary inquiry.

Traffic examiner Christopher Howarth reported that he went to check Marsh's tachograph records fallowing information that a vehicle had been used while not taxed. It was alleged that the vehicle had not beer taxed until May, as it had been kept on the Continent for the previous nine months.

The TC referred to a report from Dover police that a vehicle driven by Marsh had been seen in Dover docks in March 2000 displaying a tax disc which had expired at the end of December 1999. Evidence from the DVLA was that the vehicle was not taxed until May 2000.

Marsh claimed he did not know it was wrong to have an untaxed vehicle in Dover docks. The vehicle was not being used on British roads as all his work was Continental.

Asked about a conviction at Macclesfield against a driver for falling to produce tachograph records, Marsh denied any knowledge of this case, saying he did not employ a driver of that name. Adjourning the proceedings until April, the TC said she wanted to see the original inspection records. She also wanted details of the Macclesfield case and clarification on the taxation of three of the four vehicles being operated.
