The Tribunal directed Lewis to reconsider the imposition of the condition because the company had not been given an opportunity of making representations about the effects the condition might have on its business.

In December, the company said it was prepared to accept a restriction allowing movements only between 4am and 9pin if [Awls thought it necessary to impose any condition.

hi his decision, Lewis said it is important that residents' sleep is not disturbed at night. 'Hie residents subsequently complained about earlymorning movement of vehicles.

But he accepted that 6am is not an early enough start for the company's vehicles, so he is prepared to advance that to Sam.

Except in an emergency. the maintenance and movement restriction applies before Sam and after 9pm, as well as on Sundays and public holidays.
