If the drivers are to be employed by you, you will be regarded as the user of the vehicles and you will have to hold an Operator's Licence.

But to enable such alternative arrangements to be made, the law provides for the situation where a licence holder dies and the business is continued by another person.

You should notify the Licensing Authority of your father's death as soon as possible. Under Regulation 32A of the Goods Vehicles (Operators' Licences, Qualifications and Fees) Regulations 1984, an LA can direct in this situation that the person currying on the business is to be treated as the licence holder for up to 12 months or, in special circumstances, up to 18 months. He can make such a direction in the case of a standard licence, even if the person carrying on the business is not professionally competent The time allowed by the LA will give you time to make an application for a new licence in your own name and, if you do not have a CPC, to obtain one.
