• Operators 34, who hold a licence in the name of a lim ited company are required to notify any change in directorship to the Traffic Commissioner, and those who fail to do so will be penalised.

This was made plain by South Wales and West Midland Traffic Commissioner John Mervyn Pugh, when he adjourned consideration of disciplinary action against the licence held in Newport, Gwent by Pak Halal Meat Co, together with its application for a new four-vehicle licence based in Birmingham.

The case had previously been adjourned for the company to take legal advice and pay outstanding fines.

For Pak Halal, Michael Carless said that the fines, totalling £3,108.33, had now been paid. The offences had arisen when Newportbased vehicles had been used in Birmingham. Directors Mohammed Akhram and Aswam Javed had resigned in May 1996 and May 1997 respectively; director Aziz Sur Raman was appointed company secretary in October 1996. The TC pointed out that the Traffic Area had not been notified of any of these changes. The application form, which was dated July 1997, showed Javed as the sole director, and it had been signed by Rahman as company secretary. Rahman said that when he filled in the form he had not realised the date of Javed's resignation.

Mervyn Pugh adjourned the proceedings for the company to make a fresh application and to notify the Traffic Area of the correct position. He said the important question was: who were the directors when the offences were committed? If Javed was not a director in July, why on earth had Ralunan said that he was? He had to be sure that the wool was not being pulled over his eyes.
