A COMPANY has been fined £1 0000 after pleading guilty to health and safety failings that led to a truck driver's death under granite slabs.

Lubomir Tihlar died after he was crushed by the six-tonne slabs at Staffordshire-based Just Granite in November 2005.

When they appeared before Staffordshire magistrates, company directors Nicholas and Judith Allen admitted charges of failing to ensure the safety of people other than employees, and of failing to carry out an adequate risk assessment on this job. An inquest had previously ruled that Tihlar's death had been an accident.

Tihlar was inside an LGV which was dropping off granite slabs at Just Granite in Penkridge, Staffs when he removed safety chains in the trailer. As he moved a load from another part of the truck, the granite slabs fell on him, pinning him against the side.

Health and Safety Executive investigating inspector Peter Yoxall said there were failings on the part of Nicholas Allen, who oversaw the unloading but was unaware Tinier in the truck.

The magistrates also ordered Just Granite to pay more than E4,000 in costs. The name of the company which employed Tihlar was not disclosed.
