A BERKSHIRE subcontractor has still not been paid by Norbert Dentressangle, despite a court order ordering the French giant to pay up after a load was stolen.

Bradley Nussey says ND accused him of wilful misconduct when his load of combination boilers was stolen at Wentbridge Services off the Al (CM 24 November). ND asked loss investigators CSL Claims Services to look into the matter and decided that Nussey, who trades as BS Nussey Haulage, had not stopped at "standard official services". Nussey then obtained a judgment from Newbury County Court ordering ND to pay the £3,193.22 plus £120 costs. ND legal director Patrick Lheureux wrote: "You have obtained a judgment from an English Court for the payment of your outstanding freight invoices. But as you have not respected the French rules of information of a proceed, you will have no possibility [for] this judgment to be applied." He says ND will pay Z1,732.65 — if

Nussey contributes towards the cost of the stolen load.

Nussey says "They have faxed through to me a couple of release forms showing me they are not accepting the offer. They are clutching at straws."
