• Twelve overloading charges against Basingstoke-based Janaway Farms have been thrown out by Southampton magistrates and the company's defence costs will be met out of public funds.
The company denied using vehicles on the public road overloaded by up to 15.5% in September, October and November 1990. The alleged offences were revealed when Hampshire Trading Standards officers seized a number of tickets from a weighbridge operated by Continental (UK) at Eastern Docks, Southampton. The company confirmed that it had owned and used the vehicles concerned on the dates in question.
Brian Singleton, Continental (UK)'s weighbridge operator, said that the letters on the weight tickets indicated that the grain being carried had been collected outside the docks.
Questioned by Jonathan Lawton, defending, Singleton said that on occasion grain was carried from one dock silo to another but he was unable to tell from the ticket codes.
Lawton argued that there was no evidence that any load had been carried on the public road.
