Which of the following most accurately describes the problem?

• The RHA-opposed application by K. Stainier Haulage Contractors (Macclesfield) Ltd was withdrawn at a resumed public inquiry in Manchester on Monday.

K. Stainier Haulage had originally applied for an operator's licence for six vehicles and three trailers in possession with a margin of two vehicles and one trailer to be acquired.

An objection was lodged by the RE-IA on the grounds that the company did not have sufficient financial resources and that there had been a period of unlawful operation between August and October last year.

The hearing was twice adjourned (CM January 26 and July 6) to allow the company time to produce proper evidence of its financial position; on the last occasion the LA granted the firm an interim licence to enable it to continue operating until such evidence could be produced.

However, at Monday's hearing the North Western LA, Mr Charles Hodgson, was told by Mr John Lawton, representing the applicant company, that the figures which had been required had now been made available and that these showed a definite trading loss. Therefore, it had been decided to withdraw the original application and lodge an interim application in the name of Swamac Transport, of Macclesfield, which would be the trading name of Mr Peter Swain, who had taken over the post of chairman of K. Stainier Haulage shortly before the last inquiry in July.

For the R HA, Mr John Backhouse said that the Association would have no objection to the new application so long as an assurance was given that Mr K. Stainier, who had appeared at an initial bankruptcy hearing involving £25,000 on January 12 this year, was in no way financially involved with Swamac Transport. This assurance was given by MrLawton, and Mr Hogson granted a three-month interim licence to the new firm.
