first Munro hearing • Robert Walker, a driver employed by Allen Munro Transport, was fined £150 by Ormskirk magistrates after being convicted of making a false entry on a tachograph record.

This is one of a series of cases arising out of an article in The Observer alleging drivers' hours abuse and tachograph record falsification by the company's drivers. Allen Munro Transport subsequently served a writ for libel on The Observer.

Walker, of Sutton Avenue, Tarleton, Preston, had denied the offence. Prosecuting for the Vehicle Inspectorate, Mark Laprell said the gate records at Munro's depot at Pimbo, Lanes showed Walker's vehicle leaving the depot at a time not recorded on the tachograph chart. Walker said he could not remember what he had done on the date concerned, but thought he had taken his vehicle from the depot to a commercial garage at Kirkby for servicing. He denied deliberately falsifying the tachograph chart.

Defending, Stephen Kirkbright said there had been no reason for Walker to falsi Gate records fy the tacho at a time not ing the journey recorded on the concerned he graph record showed vehicle He had had leaving the depot adequate daily rest and follow tachograph chart weekly rest period of 48 hours. Walker had made no financial gain whatsoever.

Seven more Munro drivers, accused of similar offences, are to be tried by the magistrates in December. Three of the seven also face charges under the Forgery & Counterfeiting Act relating to alleged falsification of tachograph charts while abroad.
